Need a web designer
I'm looking for a web designer that could possibly help me redsign my website. I need him/her to be pretty familiar with Flash and animation.
Website will contain:
-photo gallery (photos provided)
-video clips (videos provided)
-community member profiles
-membership "join" form
-graphic effects
-guest book
-music/sound effects
-a lot of animation and graphic motion
The site will be formatted a little differently from normal sites, so be ready for a long explanation when you contact me. It's going to be a personal website and I have a fairly low budget. I need it to be $800 US or less. I'm fairly loose as far as a deadline is concerned. If you're interested, email me at stnkycheezman@hotmail.com. I would refer you to the Sept. Attorney call transcript under the Members only section. I believe this question or something similar was answered there by Sonal Verma. In a nutshell, if the job requires higher qualifications that satisfy EB2 requirements only then can the petition be filed under EB2. That being said, the education equivalency may make your case a bit difficult because as per the transcript, the USCIS of late has been taking a stance that a combination of degrees will not be considered as equivalent to a US Bachelors or Masters.

I too received a similar notice. My employer replied by submitting proof of the paid checks. Meanwhile, I received my receipt notice that shows $395 received. I have also received the FP notice and the same was completed yesterday. Customer service was not of much help.

I have completed my finger printing a week back. My 485 receipt says the amount as $395. So the $70 is already included in the $395?

I think the idea is that you can choose to make your designs in to actual shirts that you sell… but it's not required as part of the competition.
In the original t-shirt contest, people were required to put their designs on Cafepress so that people could actually buy the shirts (I have two of them). Kirupa took issue with that this time:

So, this time, you aren't required to make your shirt purchasable. Hypothetically, you could put it up on Cafepress or another, similar site. I think it'd be cool if everyone did that, but I'm not running the show. :kommie:

My application is recieved by R COOK on 10th July and no news yet.
My 140 is approved on 08/17 just 2-3 days before.

Let that Champagne sit in the chiller for while. These numbers are a blip on the RADAR. Don;t expect some real job creation 'tll 2011 (or later). The private sector has to start spending and creating wealth. Government spending never causes any growth. We have all seen what Indian economy was like, in early 1990's and before that, with Government runnig it.

It wont hurt you to have both. Whichever gets approved faster only benefits you. I have an I-130 filed for me in 2001, F2B, as well as an EB3 based with a PD of May 07

As H1-B visa is tied to an employer, you should get the new H1-B stamp with your new employer as the sponsor.
At PoE, the IO may ask you to show the current employment letter, especially as you are coming to US after a long absence.

Just to let everyone know if any of you encounter the same issue -
called up USCIS Customer Service and spoke to them about this error. They said to mention this in the Cover Letter (When I send the supporting docs) as a mistake that happened while filing the EAD and what the correct answer should be. They said it'll be then taken care of.
Am going to do accordingly!

Why do you need a signature from anyone in your company (or ex-company) on your 485. I-485 is your application and your employer has nothing to do with filing it.

There is a quirk in the immigration laws that allows a person working for a cap-exempt employer to start working for a cap-subject employer once the petition is filed, even if the new H-1B status cannot start until 10/1/09. If the new employer files an LCA with a start date of 7/27, you should be able to work for that new employer under H-1B portability. However, if the new petition is denied, you lose your work authorization immediately.

I am currently working on a fulltime H1B and my GC process is going on with second stage (I140) in progress. Now my old employer wants me to work parttime for them which I agreed upon but this is a possibility only if I have a parttime H1B applied w.r.t old employer which I am thinking to apply for it and work parttime. But my question here is does this effect my GC processing? If it is what are the effects? Please reply me back. Thanks a lot.

My wife is going to apply for both H4 and H1 visa. Since marriage is in March end, she will come to US on H4 visa. Her H1 visa will be applied as if she were in India. Now her I94 will say H4. Once she gets her H1B, she will have to go out of country to get new I94.
We can go to Mexico to get it stamped and hence get new I94. If for some reason, H1B is rejected, can she still enter the US on H4 visa?

The H1, even if she gets (in the 2009 quota which needs to be applied on April 1st 2008) cannot be used before Oct 2008 as all new H1s can be used only from the month of Oct. That H1B approval will come with its I-94 attached. Once October arrives, she can start working on her H1B. She does not need to go anywhere to get it stamped.
When you go out of USA on vacation the next time, she can have her H1B visa stamped on her passport.

Unfortunately, a 212(a)(3)(B) finding would also prevent you from getting a GC based on your marriage to a US citizen.
You are entitled to renewal of your EAD as long as your GC remains pending.

I got my labor approved under perm on Sept 11th however I have not filed for I140 as yet. This is because of employer making n reasons to file the same. Anyways, if the 45 day rule comes into play - does my labor get cancelled as it has been more than 45 days since it has been approved or does the 45 day period start after April 26th. How many of you think this rule will come out. I hope it does. That way employers will have no choice but to file I 140. A lot of employers now adays are stalling filing the same since they fear the employee will move. Am I the only one facing the same problem or are there others as well?

As far as I know, USCIS considers CP as abandonment of I485 app. I am not sure you will be able to convert back to I485 again. Also, I think you will lose all your AP/EAD benefits. Check with a lawyer tho.
