    H1 with company (X) was denied on May 2008, but made appeal to it and its in the process.
    during the same time
    i have applied for H1 transfer to company (Y) throught consular processing. I got approval.
    If i go for Visa Stamping would it be a problem. Live around Ca. planning to go for Tijuana, Mexico.
    also
    Company (y) says it won't generate pay stubb unless u get visa stamped. Do i really need pay stubb(s) with
    company(Y) in order to go for stamping.or its okay to go with company (X) paystubs.
    My paystubs are still with company (x) till month of May 2008.
    how good are chances of getting visa if im going for stamping in month of July, 2008

    pls advice... what should i do in the situation i'm in

    As per this chart, wait for getting a GC in the US is as follows:

    6 months wait - 75 yrs old Kenyan, son a US citizen
    3 yrs wait - 24 yrs old Iraqi, translator, US military
    6 yrs wait - 35 yrs old South African, computer programmer
    6 yrs wait - 25 yrs old Venezuelan, student, father a US citizen
    10 yrs wait - 31 yrs old, Chinese, a factory worker
    20 yrs wait - 25 yrs old Filipino, student
    35 yrs wait - 35 yrs old Indian, computer programmer
    131 yrs wait - 30 yrs old Mexican, H.S. diploma, sister a US citizen

    My limited understanding about the GC process is that from the day I-485 is filed, a person may change his/her job only after 180 days or more, and of course by filing AC 21.

    Yes, you are correct.

    Also, in case the I-485 does not get approved within the 180 days after filing, then how can a person change a job without having an EAD.

    You can file for EAD along with 485 or after you file 485 - EAD will be issued within 90 days (as of writing w/ current processing times) from the date of filing. You can change job only after 180 days filing 485 - In order for you to work for another employer you need EAD

    A person can EAD only once I-485 is approved? Is that correct.

    You will get GC itself once 485 approved, there is no need for EAD - EAD is a temporary work permit set to expire in 1 or 2 years from the date of issue

    All above dates are 2009. My L1 B (Individual) expired in February. So I am already around 3 months over my L1 status.

    Hello,
    I am starting this thread to infuse some life into the now dormant contributions to IV. I noticed in the past few days that we have been stuck @ 70,725. All of the core IV members are busy talking to the Senators regarding the SJC bills in Washington and generally working hard to push for our cause.

    In the meanwhile i feel we as members of this group should again start the push for contributions as we are certain to face an uphill battle in the House.

    So please contribute and ask your co-workers, friends, family to also do so now. This is the least we can do... :D

    That's not completely true. There are improvements in UCIS processing. If you check H1 or I-140 processing time 2 years back , it was much worse then. I dont think USCIS processing time is a problem for us right now. Of course it would be nice to have faster service for H1 and I-140 or 485.

    How this helps: Online polling is an easy way for senators to gauge the popularity of a bill. If all the EB applicants were to VOTE yes, it
    would take the number over 200,000 easily. The most popular bill has around 7000 votes. A bill on opencongress.com having 50,000 votes
    is sure to garner a lot of attention.

    2) Forward this email to all your friends and relatives who will benefit from this bill.

    Only a systematic, organized online campaign would only us all to get LEGAL PERMANENT RESIDENT STATUS in the USA.

    LC Sub/EB2 with PD June 2001 filed on July 27 with RD of Sept 8 got approved y'day. 140 filed on July 5th was approved on jan. no RFE, all were smooth.

    I was afraid because of my last years on L1B and filed H1b though this year quota and not sure if i'm lucky to have a number lottery. This gave me major relaxation.

    Best of luck you all.

    Had 1 Soft LUD on Jan 31 on 485 application.

    USCIS is doing a great job thank to IV to make these possible.


    NJoy the USCIS broken system of LC SUB buddy.
    We (Non-LC-SUB) are not so lucky and are stuck for more than 8 years in it and still no hope.
    Nothing against you -- its just that you need to be lucky to take the right decision otherwise you will be punished like many of us.

    Sounds like you already have a lawyer, follow their advice. It looks like the RFE is to ensure that you are directly working for the sponsoring company. A letter to that effect from your supervisor should suffice in this regard. I doubt this has anything to do with the OPT/e-Verify stuff you mentioned.

    However, I am not a lawyer, so I would suggest follow your/company lawyer's advice.

    U.S. Citizenship and Immigration Services (USCIS) has launched its newly re-designed Web site (http://www.uscis.gov/portal/site/uscis). Although the Web site update was scheduled to be introduced September 22, 2009, attorney Eugenia Ponce visited the site Monday and has this report:

    The updated Web site is organized according to categories.The categories are displayed as Topics, Forms, Resources, Laws, News, and About Us. The topics are categorized as follows: Adoption, Permanent Residence, Humanitarian, Citizenship, Members of the Military and Their Family, Family, Visit the U.S., Working in the U.S, and Genealogy. After clicking on a specific topic, I was provided helpful information and even more additional information was available through the links on the left of the screen.The advantage of categorizing the information by topic is that individuals are now able to familiarize themselves with the process from start to finish. There are other helpful links and tools within each specific topic.

    Another key feature to the Web site is that there is a “where to start” link. Before, individuals could navigate throughout the Web site not knowing where to even begin their search on a narrow issue. Now, the “where to start link” will allow individuals to begin their immigration search by narrowing it down to their specific issue. For instance, there is a scroll-down available for individuals under the “where to start” link. It states “I Am,” and one can select from the various choices available and get specific information relating to any issue.

    similar situation. Applied to NSC but received EAD from CSC. So EAD as number starting with CSC, I was thinking of choosing CSC.
    Any other suggestions?

    Employer needs to stop smoking weed and concentrate on work. Jokes apart there was no such proposal ever in pipeline so there is no way anything like this ever was approved. 6 year limit on H1 is a law that cannot be changed by admin process. It needs to pass house & senate. Also 6 year limit makes lot of people go back to home countries and uncle sam can consume their SS & Medicare taxes.

    To all fellow GC applicants and immigration gurus.I have this question to ask.I recently got my I-140 and applied I-485 (Aug 1 2007).
    My employer is moving office to new address.How will it effect my future GC process ?. Thanks in advance

    If the company is moving within the same county then no issues.

    If it's moving to a different state (or) to a different county within the same state, then refer the following thread

    Thanks guys for reading such a big article and taking time to know against whom we are really fighting for. I hope every one read this article and know the people behind the scene, their intentions, the power and clout they have.

    This may help all of us to be united to fight against such powers leaving all our diferences for a good cause, which is a herculian task.

    I only hope all members of IV stand united to achieve success.

    The preadjucation process is just like bringing a pregnant woman into labor but not allowing her to give birth till the babies number comes . The woman then needs to be painful labor for 28 years ( some member said that’s how long it will take ) , so the baby is grown and healthy ( preadjucated according to USCIS ) , but the doctors from the Department of state ( DOS ) are not allowing the baby to come out into the world .


    USCIC is off late preadjucating the petitions and keeping them ready and many members seem to thrive on just seeing and discussing the LUD dates since by now most of us know somewhere in the subconsious that the GC is a nothing but a bone tied to our tail which we might never be able to bite .

    Some members including me who unfortunately lack the analytical skills of some looked into a very interesting thread some time back which said EB2 will be current within a year . It spoke about 'spillovers' and we all were very happy that finally our baby will see the light of the day . Just like hope never dies I even though the dates have moved back to a date when most of us were in graduate college and the Clinton administration just left , some members are still now hopeful of a "spillover".

    I for one have done what it takes for 4 long years in all ways possible to wake these guys up and now I am honestly least bothered about my GC and I feel the earlier members get to this level of mindset it will give them a lot of mental peace . I am just waiting for my visa to expire or my wall street employer to lay me off( whichever happens earlier ) in which case I also get a free ticket home .
    The expectation that "next month may be the month" will surely kill you long before your GC actually gets cleared ( after 28 years ) .

    I have few question regd H4 visa.

    1. how H4 visa holder can study using education loan from india? if they get money through bank-to-bank transfer for education, they have to pay taxes right?

    2. also now I know F1 students get their SEVIS number and this number helps DHS to track the students study programs/activities/money in US. This SEVIS number is given to F1 students by DHS.

    so if H4 get this (education loan) money through bank-to-bank transfer, whether it will create a problem for H4 because they brought money from india without SEVIS number?

    Please let me know.
